TERMS AND CONDITIONS BY PARTICIPATING IN THE “SMSPREP HIGHER SCORE GUARANTEE” PROMOTION (THE “PROMOTION”) OFFERED BY SMSPREP, INC. (“SMSPREP”), YOU ARE UNCONDITIONALLY CONSENTING TO BE BOUND BY AND ARE BECOMING A PARTY TO THESE TERMS AND CONDITIONS ("AGREEMENT"). IF THESE TERMS ARE CONSIDERED AN OFFER, ACCEPTANCE IS EXPRESSLY LIMITED TO THESE TERMS. 1. Eligibility. To qualify for the Promotion, you must: (a) prior to beginning use of the smsPREP test preparation service (the “Service”), have taken an official SAT or ACT test (the “Pre-Service Test”); (b) complete at least one hundred (100) test preparation questions using the Service; (c) take an official SAT or ACT test after completing one hundred (100) or more questions using the Service (the “Post-Service Test”) and receive a lower combined score than the score you received on the Pre-Service Test. Collectively, (a) through (c) are the “Eligibility Requirements”. 2. Promotion. Provided that you have satisfied all of the Eligibility Requirements and complied with all other terms of this Agreement, if your score on the Post-Service Test is lower than your score on the Post-Service Test, smsPREP will provide you with free access to the Service to prepare for another official SAT or ACT to be taken within eight (8) months after the date of the Post-Service Test. To initiate this process, you must notify smsPREP within thirty (30) days after the date of the Post-Service Test. If smsPREP determines that you are eligible for the Promotion, you will receive an email with a request for official score reports for the Pre-Service Test and the Post-Service Test. Official score reports must be received by smsPREP within thirty (30) days of such request. 3. Terms of Use and Privacy Policy. smsPREP's Terms of Use and Privacy Policy, made available online at http://smsprep.com/terms and http://smsprep.com/privacy, as those policies may be changed from time to time, are hereby incorporated by reference into this Agreement, and you agree to be bound by and shall at all times comply with such Terms of Use and Privacy Policy. It is your responsibility to be aware of any changes to these Terms and Conditions by checking the Terms of Use and the Privacy Policy regularly. |
